Terms of Service

These Terms of Service ("Terms") govern your use of Numbers, a daily math puzzle game available at playdailynumbers.com (the "Service"), operated by Jonathan Osborn ("we," "us," or "our").

By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you're between 13 and 16 in certain jurisdictions, you may need parental consent. By using the Service, you represent that you meet these age requirements.

2. Accounts

You can play Numbers without an account, but signing in lets you save your streak across devices, appear on leaderboards, join groups, and subscribe to NUMBERS+.

When you create an account, you agree to:

• Provide accurate information.
• Keep your account credentials secure.
• Notify us if you suspect unauthorized access.
• Choose a username that doesn't impersonate others or contain offensive content. We may remove or change usernames at our discretion if they violate these rules.

You are responsible for all activity on your account.

3. NUMBERS+ Subscriptions

NUMBERS+ is our paid subscription that unlocks daily percentile rankings, the puzzle archive, group creation, full leaderboards, streak shields, and other premium features.

3.1 Pricing and billing

NUMBERS+ is offered at:

• Yearly: $4.99 per year (auto-renewing)
• Monthly: $0.99 per month (auto-renewing)

Prices are displayed in U.S. dollars. We may adjust pricing in the future; if we do, we'll notify you in advance and the change will apply to your next billing cycle.

3.2 Free trial

New NUMBERS+ subscribers may be offered a 7-day free trial. During the trial, you'll have full access to NUMBERS+ features. Your subscription will automatically convert to a paid subscription at the end of the trial unless you cancel before it ends. You can cancel at any time during the trial without being charged.

3.3 Auto-renewal

Your NUMBERS+ subscription automatically renews at the end of each billing period (yearly or monthly, depending on what you chose) unless you cancel before the renewal date. The renewal charge will appear on the payment method on file.

3.4 Cancellation

You can cancel your NUMBERS+ subscription at any time through the "Manage NUMBERS+" link in your account settings, which opens our billing portal hosted by Stripe.

When you cancel, your subscription remains active through the end of the current billing period. You'll continue to have access to NUMBERS+ features until that date, after which your account will revert to the free tier.

3.5 Refunds

We do not offer refunds for partial billing periods. If you cancel mid-period, you keep access until the period ends but no refund is issued for the remainder.

If you experience a billing issue, error, or unauthorized charge, contact us at hello@playdailynumbers.com and we'll work with you to resolve it. Eligibility for refunds in such cases is determined on a case-by-case basis and at our discretion.

3.6 Payment processing

Payments are processed by Stripe via RevenueCat. By subscribing, you agree to Stripe's and RevenueCat's terms of service in addition to these Terms. We do not store your full credit card number or banking details.

4. Acceptable Use

When using the Service, you agree NOT to:

• Use the Service for any illegal purpose or in violation of any law.
• Attempt to gain unauthorized access to other users' accounts or our backend systems.
• Reverse-engineer, decompile, or otherwise attempt to extract source code from the Service.
• Use automated tools (bots, scrapers, scripts) to interact with the Service in ways that disrupt normal gameplay or attempt to game leaderboards.
• Submit fraudulent solve times or otherwise manipulate game data.
• Harass, abuse, threaten, or impersonate other users.
• Use offensive, hateful, sexually explicit, or harassing language in usernames, group names, or other public-facing content.
• Resell, sublicense, or commercially exploit the Service without our written permission.

We may suspend or terminate accounts that violate these rules, at our discretion and without notice.

5. User Content

You're responsible for the usernames, group names, and any other content you create on the Service. You grant us a worldwide, non-exclusive, royalty-free license to display this content within the Service for the purpose of providing the Service to you and other users.

You retain ownership of your content. You can delete your content (and your account) at any time by contacting us.

6. Intellectual Property

All puzzles, gameplay mechanics, design, branding, and software comprising the Service are owned by Jonathan Osborn and are protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.

You are welcome to share your puzzle results on social media or with friends.

7. Service Availability and Changes

We do our best to keep the Service running smoothly, but we don't guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

We may add, remove, or change features (including NUMBERS+ features) without prior notice. We'll do our best to communicate significant changes in advance, especially to paying subscribers.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We don't guarantee that:

• The Service will meet your requirements or expectations.
• Your puzzle results, streaks, or other data will be preserved indefinitely.
• The Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent permitted by law, Jonathan Osborn will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of (or inability to use) the Service, even if we've been advised of the possibility of such damages.

In any event, our total liability to you for any claim related to the Service shall not exceed the amount you've paid us in the past 12 months, or $100, whichever is greater.

Some jurisdictions don't allow limitations on liability, so portions of this section may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Jonathan Osborn from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms.

11. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms.

Upon termination:

• Your NUMBERS+ subscription remains active through the end of the current billing period (if applicable).
• We may retain certain data as required by law or for legitimate business purposes (e.g., to prevent fraud).
• Provisions of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will remain in effect.

12. Modifications

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date and may notify you via email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Service will first be addressed through informal negotiation. If we can't resolve the dispute informally within 60 days, the dispute will be resolved by binding arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) in Kitsap County, Washington, or by small-claims court if the dispute qualifies.

You agree that any dispute will be brought in your individual capacity, not as a plaintiff or class member in any purported class action.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
